I. EZwebplans utilizes servers hosted by 1and1. In addition to EZwebplans terms, all customers must be aware of and abide by 1and1 policies found here: 1and1 General Terms & Conditions
II. EZwebplans is not responsible for server-related problems incurred by 1and1 including any "down time" which may incur. Although 1and1 provides back-up services, EZwebplans will attempt to provide secondary back-up to all files as a complementary service only. EZwebplans will not be held liable for secondary back-up failure. Any unrecoverable data lost by the hosting server will either be regenerated by EZwebplans or a refunded amount will be credited to the customer which shall not exceed the amount of an annual subscription cost.
III. EZwebplans is not responsible for any events which may occur that can be classified as "force majeure". EZwebplans is not responsible for any negative interpretations of a web site or any "loss of sales" from a web site viewing. EZwebplans is not responsible for any alterations made from outside sources such as those done by hackers.
IV. During any subscription period, unless stated otherwise, all domain name registrations, data folders, data files, and email administrations will be owned and operated by EZwebplans. EZwebplans in no other way shall be deemed associated with the affairs of its subscribers, including the successes and failures of each person, business, or organization. Early termination of a subscription, a domain transfer request, and a domain ownership transfer request may be purchased from EZwebplans for $25.00 after a signed forfeiture of any unused subscription time is submitted.
V. EZwebplans reserves the right to refund and terminate an account at any time. If EZwebplans executes this right, they are relieved of any legal issues which may have arisen beforehand with the customer. A refund shall not exceed the costs of an annual subscription with EZwebplans. If for any reason EZwebplans terminates an account, the customer will be given an opportunity to gain ownership and transfer any and all domains associated with that customer.
VI. Each subscription period is prepaid for 12 months and must be renewed with an annual payment to continue services with EZwebplans. Unless additional services are added or subtracted, subscription costs will be the same as the prior year. Billing and invoicing for the each year may begin as early as 60 days prior to expiration date to prevent unnecessary domain renewal.
VII. EZwebplans assumes permission to place a banner link back to EZwebplans' homepage on any of its customer's pages.
VIII. EZwebplans Privacy Statement: We will collect no personal information about you when you visit our web site unless you choose to provide that information to us. Any information you choose to provide on the web site will only be used to provide or improve services. We value our customers and their privacy. We appreciate our customers' trust and would do nothing to jeopardize that trust!
